A High Court sitting in Kano state has cleared Fatima Musa Hamza, popularly known as Hanan, of all charges bordering on causing grievous wounds to her husband, Mr Sa’id.
Justice Lawan Wada gave the verdict as a result of lack of evidence.
Secretary of the International Federation of Women Lawyers (FIDA), Amina Umar Hussain informed DPH NEWS of this development.
According to her, the case was severely adjourned by the court and the prosecutor didn’t provide any substantial evidence which caused the court to strike out the case.
“The court adjourned the case for hearing and it has been severely adjourned for hearing without the nominal complainant for once appear in court to approve his case. As the law requires, any case which suffers several adjournment at the instance of the prosecution, such case can be struck out of court,” she said
She added that Hanan is now free unless the prosecution has evidence or witnesses that can come up.
Fatima Musa Hamza is a law student at Bayero University, Kano.
She was arraigned before the High court sometime in 2019 for allegedly causing grievous bodily harm to her husband, Mr Sa’id which sparked outrage on social media outlet.
After series of inquiries and investigations it was later revealed that the accused was allegedly beaten by her spouse which made her acted in self defense to protect her unborn child.
International Federation Of Women Lawyers (FIDA), DPH NEWS has been on the case right from the police station to magistrates court, and then the high court.
